What is the difference between a design registration and a patent?

A patent (under the Patents Act 1970) protects the functional / technical aspects of an invention — its novelty, inventive step, and industrial applicability under s.2(1)(j) and (ja). A design registration (under the Designs Act 2000) protects the **visual appeal** of an article — its shape, configuration, pattern, ornament, or composition of lines or colours — under s.2(d). A single product may have both a patent on its functional mechanism and a design registration on its appearance; the two are not mutually exclusive.

Is design registration mandatory in India?

No, design registration is not mandatory — but unregistered designs have no statutory protection against piracy. Under the Copyright Act 1957, an artistic work applied to an article by an industrial process more than 50 times ceases to enjoy copyright protection (per the Delhi High Court in *Samtech Electronics v. Godrej Industries* (1999) PTC 70 — and codified in s.15 of the Copyright Act 1957 — the proviso to s.15(2) limits copyright in a design registered under the Designs Act 2000 to the term of the design registration). Without design registration, the article has neither design nor copyright protection.

What is the government fee for Form 1?

₹1,000 (natural person / start-up) / ₹2,500 (small entity) / ₹5,000 (others — large entities and foreign applicants) per design per class. Where the design is applied in multiple classes under the Locarno Classification, a separate Form 1 and a separate fee are required for each class.

How long does design registration take?

There is no statutory SLA. The application number is issued instantly upon online filing. Examination typically takes 3–6 months at the Patent Office, Kolkata. Registration is granted in 6–12 months, longer if an examination objection is raised and a reply is filed.

What is the term of a registered design?

An initial 10 years from the date of registration under s.11(1) of the Designs Act 2000, extendable for a further 5 years on Form 8 — total maximum 15 years. After expiry, the design enters the public domain and cannot be re-registered.

Can a design be registered if it has been published before filing?

Generally no — under s.4 of the Designs Act 2000, the design must be new or original, meaning not previously published in India or any country. There is no statutory grace period in India (unlike the U.S. 1-year grace or the EU 12-month grace). Where the design has been shown at a notified exhibition under s.18, a 6-month grace period may apply — but this is narrow and applies only to officially-notified exhibitions.

What is the ₹25,000 cap on damages for design piracy?

Per s.22(2)(a) of the Designs Act 2000, the registered proprietor may recover from any one infringer contractual damages **not exceeding ₹25,000** as the total sum recoverable in respect of any one design — this is a statutory cap. Per s.22(3), the proprietor may **also** elect to sue in a civil court for contract damages **without** the statutory cap, plus an injunction — the civil court may award higher damages on proof of actual loss.

Can a foreign applicant file a design application in India?

Yes — a foreign applicant may file Form 1 in India, paying the "others" fee of ₹5,000 per class. Where the applicant's home country is a Paris Convention member (India is a member since 7 December 1998), a 6-month priority claim may be available — **NOT CONFIRMED — PROFESSIONAL VERIFICATION REQUIRED** for the operationalisation of the priority filing procedure in the Designs Rules 2001.
