What is the Madrid Protocol?

An international treaty administered by WIPO that allows a single international trademark application to be filed through one's national Office of Origin (in India, IP India), designating multiple member countries. India joined on 8 July 2013.

Who can file an MM2(E) from India?

Indian nationals, domiciliaries, or persons with a real and effective industrial or commercial establishment in India. The international application must be based on an Indian "basic application" (TM-A filed) or "basic registration" (registered mark).

What is the WIPO Madrid fee?

Basic fee 653 CHF (black-and-white) or 903 CHF (colour mark), plus a complementary fee of 100 CHF for each class beyond 3, plus a designation fee (90 CHF per designation per class — NOT CONFIRMED, verify on wipo.int/madrid/en/fees/). Some countries have individual fees instead.

What is "central attack"?

Under Madrid Article 6, if the basic Indian mark is refused, withdrawn, or cancelled within 5 years of the international registration date, the international registration is cancelled across all designated countries. Remedy is transformation (Form MM24) within 3 months, converting into national applications.

How long does Madrid protection take?

IP India certifies within 2 months. WIPO IB records and publishes in 2–4 months. Each designated Office has 12–18 months to issue a refusal. If no refusal, the mark is protected in that country.

Can I add more countries later?

Yes — via Form MM3 (Subsequent Designation), filed directly with WIPO IB or through IP India. The fee is 300 CHF basic + 100 CHF per designation per class.

Do I need to maintain the Indian basic mark separately?

Yes — the Indian basic mark must be renewed every 10 years under s.25 (Form TM-R, ₹5,000 per class). The international registration is also renewed every 10 years via Form MM4 directly with WIPO IB.

Can I file a Madrid application before the Indian basic mark is registered?

Yes — the Madrid application can be based on a basic application (filed TM-A) or a basic registration. However, the "central attack" risk runs for 5 years regardless of whether you used a basic application or registration.
